A: After your initial application for veterans’ disability benefits is denied (or after you receive news that your compensation will be lower than you believe is appropriate), you have one year to write a Statement of the Case to your VA office. After that, you have 60 days to file a formal appeal to the Board of Veterans Appeals.
If your initial VA benefits claim appeal is denied, you have 120 days from the date of your decision letter to appeal to the United States Court of Appeals for Veterans' Claims.
While looking over these deadlines, keep in mind that the faster you move through the appeal process steps, the faster you will receive your decision and benefits. Because the process can take so long and because there are often delays, taking the necessary steps toward your appeal as quickly as possible will minimize the time you will wait. It is not unusual for the appeals process to take months or even years.
